У лютому 2023 року між санаторієм та Національної службою здоров’я України укладено договір Про медичне обслуговування населення за програмою медичних гарантій», зокрема, за пакетом № 53 «Реабілітаційна допомога дорослим і дітям в стаціонарних умовах» загальною вартістю 122, 3 млн грн.

Як встановило слідство, для того щоб підписати цей договір, директор санаторію задекларував недостовірні відомості про відповідність усім вимогам НСЗУ для надання реабілітаційної допомоги.

Фактично в порушення галузевих стандартів із надання реабілітаційної допомоги за відсутності матеріально-технічної бази, медичного персоналу санаторій не міг надати обсяг послуг за Програмою медичних гарантій. Крім того, у закладі проігноровано більшість наказів МОЗ, відсутні затверджені клінічні протоколи, не розроблені положення про відділення, посадові обов’язки медичного персоналу тощо.

Для того, щоб надати своїм діям правомірного характеру, директор працевлаштовував лікарів фізичної та реабілітаційної допомоги переважно «на папері», укладаючи фіктивні договори з субпідрядниками для надання послуг лабораторних досліджень, інструментальної діагностики. Все це унеможливлювало пацієнтам отримання повноцінної реабілітаційної допомоги та підривало довіру громадян до систему охорони здоров’я в цілому.

Зʼясовано, що значна частина військовослужбовців були позбавлені можливості отримати якісну безоплатну реабілітацію. У кращому випадку тих, хто потребував кардіо-респіраторної, опорно-рухової, неврологічної, посттравматичної реабілітації лікували електрофорезом, грязями та мінеральними водами, що жодного стосунку до доказової реабілітації немало.

Зазначені порушення підтверджені висновком Північно-східного офісу Держаудитслужби, висновком судово комісійної економічної експертизи. Загалом сума матеріальної шкоди державі сягає 78,8 млн грн.

За результатами проведених обшуків вилучено документацію, зокрема договори за 2024-2025 укладені з НСЗУ з аналогічними порушенням умов контрактування.

Сьогодні прокурори Офісу Генерального прокурора директору санаторію повідомили про підозру у вчиненні кримінального правопорушення, передбаченого ч. 5 ст. 191 КК України.

In Kharkiv region the director of one of the state sanatoriums of Ukrprofozdorovnytsia PRJSC is suspected of misappropriation UAH 78.8 million allocated for the rehabilitation of children and military personnel

In February 2023, the sanatorium and the National Health Service of Ukraine concluded an agreement on medical care for the population under the medical guarantee program», in particular, under the package № 53 «Rehabilitation assistance for adults and children in inpatient conditions» with a total cost of UAH 122.3 million.

As the investigation established, in order to sign this contract, the director of the sanatorium declared inaccurate information about compliance with all the requirements of the National Health Service for the provision of rehabilitation assistance.

In fact, in violation of industry standards for the provision of rehabilitation assistance in the absence of a material and technical base and medical personnel the sanatorium could not provide the scope of services under the Medical Guarantee Program. In addition, the institution has ignored most of the orders of the Ministry of Health, there are no approved clinical protocols, regulations on departments, job duties of medical personnel, etc. have not been developed.

 In order to give his actions a legitimate character, the director employed doctors of physical and rehabilitation care mainly «on paper», concluding fictitious contracts with subcontractors for the provision of laboratory research services, instrumental diagnostics. All this made it impossible for patients to receive full-fledged rehabilitation care and undermined citizens' trust in the health care system as a whole.

It was found that a significant part of the servicemen were deprived of the opportunity to receive high-quality free rehabilitation. At best, those who needed cardio-respiratory, musculoskeletal, neurological, post-traumatic rehabilitation were treated with electrophoresis, mud and mineral waters, that has nothing to do with evidence-based rehabilitation.

These violations are confirmed by the conclusion of the North-Eastern Office of the State Audit Service, the conclusion of the judicial commission economic expertise. In total, the amount of material damage to the state reaches UAH 78.8 million.

According to the results of the searches, the documentation was seized, in particular, the contracts for 2024-2025 concluded with the National Health Service of Ukraine with similar violations of the terms of the contract. 

Today, the prosecutors of the Prosecutor General`s Office notified the director of the sanatorium on suspicion of committing a criminal offense provided for in part 5 of Art. 191 of the Criminal Code of Ukraine.

The pre-trial investigation is carried out by the Main Investigative Department of the National Police of Ukraine with the operational support of the Department of Strategic Investigations of the National Police of Ukraine

Note: According to the first part of Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court conviction.
