The manager of a limited liability company engaged in international transportation, as well as an individual entrepreneur, have been notified of suspicion of organizing the illegal transportation of persons across the state border, unauthorized interference in the operation of an automated system, and altering information within it (Part 2, Part 3 of Article 332, Part 5 of Article 361, Part 1, Part 3 of Article 362 of the Criminal Code of Ukraine).
Two carriers, who hold a license for international transportation, organized a scheme that allowed men of conscription age to illegally leave Ukraine during the state of martial law. They entered the data of such individuals into the state system "Shlyakh," which is used to monitor the departure of international drivers.
The actual management of the activities of one of the companies was carried out by the owner's son. For this purpose, the father transferred his electronic key to him, which provides access to the system. On behalf of the licensed enterprise, the son illegally entered information into "Shlyakh" about men who were not his employees.
Another entrepreneur, who also had a license for international transportation and access to the system, joined the implementation of the scheme. Together, they entered false information about drivers to provide them with grounds for leaving the country.
Civil law contracts with such individuals were concluded formally and were not included in the accounting reports.
It has been preliminarily established that under this scheme, data on 40 individuals of conscription age were illegally entered into the system.
The pre-trial investigation is being conducted by investigators of the Main Investigation Department of the National Police in the Chernivtsi region with operational support from the Strategic Investigations Department, the Cybercrime Prevention Department of the National Police, under the procedural guidance of prosecutors from the Chernivtsi District Prosecutor's Office.
Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
