Прокурори Волинської обласної прокуратури скерували до суду обвинувальний акт стосовно колишнього генерального директора ДП «Волиньвугілля» за нецільове використання понад 31 млн грн коштів державного бюджету та службове підроблення – ч. 1, ч. 2 ст. 210, ч. 1 ст. 366 КК України. Упродовж березня-грудня 2022 року та лютого-березня 2023 року він скеровував кошти, призначені на реструктуризацію вугільної галузі та оплату праці працівників вугледобувного підприємства, на виплату заробітної плати адміністративно-управлінському апарату ДП та його відокремлених підрозділів. 

Також за результатами досудових розслідувань у низці кримінальних проваджень прокурори Волинської обласної прокуратури повідомили про підозру посадовцям органів місцевого самоврядування, митниці, керівникам комунальних і державних установ, причетним до незаконних дій із бюджетними коштами, зловживання службовим становищем, вимагання й одержання неправомірної вигоди.

Начальник виробничого підрозділу «Радошинський піщаний кар’єр», що належить до сфери управління АТ «Укрзалізниця», залучивши п'ятьох підлеглих, організував схему продажу піщаної суміші за готівку за заниженою ціною без відображення таких операцій в бухгалтерському обліку, а також схему привласнення палива. Члени організованої групи здійснили розтрату піску вартістю 5,02 млн грн. Окрім того, шляхом безпідставного списання палива АТ «Укрзалізниця» завдано збитків у розмірі 770 тисяч гривень.

Два головних державних інспектори відділів митного поста «Ягодин» Волинської митниці, вносячи неправдиву інформацію в офіційні документи та автоматичну систему «Інспектор», пропускали на митну територію України незадекларований товар без сплати обов'язкових митних платежів. Сума збитків: понад 2,7 млн грн.

Директор приватного підприємства, яке виконувало роботи з будівництва укриття в закладі освіти в місті Ковелі, вносячи до звітної технічної документації недостовірні відомості через відображення безпідставно завищеної вартості використаних матеріалів, незаконно заволодів коштами місцевого бюджету на суму 2,5 млн грн.

Колишній директор комунального підприємства «Володимиртепло» без проведення тендерних процедур уклав із фізичною особою-підприємцем договір про постачання палива для котелень, внаслідок умисного невиконання якого підприємству завдано збитки на суму понад 2,7 млн грн.

Директор однієї із багатопрофільних лікарень області, депутат Маневицької селищної ради, зловживаючи службовим становищем, закупив обладнання для лікарняного закладу за завищеними цінами. Сума завданих державі збитків: більше 1,6 млн грн.

Директор приватного підприємства у Володимирі при виконанні робіт із капітального ремонту корпусу Володимирського центру професійної освіти, завищуючи вартість та об'єми виконаних робіт, привласнив бюджетні кошти. Сума збитків: 760 тисяч гривень.

На цьому ж об'єкті спеціаліст із технічного нагляду вносив до актів приймання виконаних робіт завідомо неправдиві відомості. Сума збитків, заподіяних бюджету цими незаконними діями: 100 тисяч гривень.

Колишній генеральний директор КП «Луцьке підприємство електротранспорту», внаслідок безпідставного укладення додаткових угод до договору про постачання електроенергії, вчинив розтрату коштів підприємства. Сума збитків: понад 765 тисяч гривень.

Підгайцівський сільський голова безпідставно підписав 11 додаткових угод до договору про постачання електроенергії, відтак постачальнику були сплачені зайві кошти за придбання її за завищеною ціною. Сума збитків: 476 тисяч гривень.

Директор одного з департаментів Луцької міської ради також безпідставно підписав 11 додаткових угод до договору про постачання електроенергії, внаслідок чого орган місцевого самоврядування зайво сплатив постачальнику кошти. Сума збитків: 424 тисячі гривень.

Начальник Регіонального офісу водних ресурсів у Волинській області разом із двома підлеглими, запровадивши систему «відкатів», заволоділи майже 590 тис. грн готівкових коштів, виплачених працівникам установи у вигляді премій. Окрім того, керівника підозрюють у вимаганні й одержанні неправомірної вигоди. 

Дії підозрюваних кваліфіковано за ч. ч. 4, 5 ст. 191, ч.ч. 1, 2 ст. 364, ч. 3 ст. 368, ч. 1 ст. 366 КК України.

Наразі прокурори готують клопотання про обрання запобіжних заходів та відсторонення підозрюваних від займаних посад.

Загальна сума встановлених збитків у кримінальних провадженнях становить близько 50 млн грн.

Досудове розслідування здійснюється за процесуального керівництва прокурорів Волинської обласної прокуратури, Луцької та Володимирської окружних прокуратур у взаємодії з ГУНП, УСБУ, БЕБ, ДБР та УСР у Волинській області.

Примітка: відповідно до ст. 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку і встановлено обвинувальним вироком суду.

The illegal deals with budget funds and other corruption crimes in Volyn region with losses of about UAH 50 million were exposed. 19 persons were notified of suspicion, another one will be tried

Prosecutors of the Volyn Regional Prosecutor's Office sent an indictment to the trial against the former director general of SE «Volynvugillya» for misuse of more than UAH 31 million of state budget funds and official forgery – part 1, part 2 of Art. 210, part 1 of Art. 366 of the Criminal Code of Ukraine. During March-December 2022 and February-March 2023, he directed the funds intended for the restructuring of the coal industry and the payment of wages to the employees of the coal mining enterprise, for the payment of wages to the administrative and management apparatus of the SE and its separate divisions.

According to the results of pre-trial investigations in a number of criminal proceedings, the prosecutors of the Volyn Regional Prosecutor's Office notified of suspicion the officials of local self-government bodies, customs, heads of municipal and state institutions involved in illegal actions with budget funds, abuse of official position, extortion and receiving illegal benefits.

The head of the production division «Radoshynsky sand quarry», which belongs to the sphere of management of JSC «Ukrzaliznytsia», having involved five subordinates, organized a scheme for selling sand mixture for cash at a reduced price without reflecting such transactions in accounting, as well as a scheme for misappropriation of fuel. Members of the organized group embezzled sand at a cost of UAH 5.02 million. In addition, through unjustified write-off of fuel, JSC "Ukrzaliznytsia" suffered losses in the amount of UAH 770 thousand.

Two chief state inspectors of the customs chechpoint«Yagodin» of the Volyn Customs Office, by entering false information into official documents and the automatic system «Inspector», had allowed undeclared goods into the customs territory of Ukraine without paying mandatory customs payments. Amount of losses: more than UAH 2.7 million.

The director of a private enterprise that carried out works on the construction of a shelter in an educational institution in the city of Kovel, by entering inaccurate information into the reporting technical documentation due to the reflection of the unreasonably inflated cost of the materials used, misappropriated of local budget funds in the amount of UAH 2.5 million.

The former director of the municipal company «Volodymyrteplo», without conducting tender procedures, concluded an agreement with an individual entrepreneur on the supply of fuel for boiler houses, as a result of the intentional non-fulfillment of which the company suffered losses in the amount of more than UAH 2.7 million.

The director of one of the multidisciplinary hospitals of the region, a deputy of the Manevytсhi settlement council, abusing his official position, bought equipment for a hospital at inflated prices. Amount of damages caused to the state: more than UAH 1.6 million.

The director of a private enterprise in Volodymyr, during the overhaul of the building of the Volodymyr Vocational Education Center, inflated the cost and volume of the completed works, misappropriated budget funds. Amount of damages: 760 thousand UAH.

At the same facility, the technical supervision specialist entered knowingly false information into the acts of acceptance of the completed works. The amount of damages caused to the budget by these illegal actions: 100 thousand UAH.

The former general director of ME «Lutsk enterprise of electric transport», as a result of the unjustified conclusion of additional agreements to the contract on the supply of electricity, embezzled the company's funds. Amount of damages: more than 765 thousand UAH.

The village head of Pidgaitsi unjustifiably signed 11 additional agreements to the contract on the supply of electricity, so the supplier was paid extra money for its procurement at an inflated price. Amount of damages: 476 thousand UAH.

The director of one of the departments of the Lutsk city council also unjustifiably signed 11 additional agreements to the electricity supply agreement, as a result of which the local self-government body overpaid the supplier. Amount of damages: 424 thousand UAH.

The head of the Regional Office for Water Resources in the Volyn region, together with two subordinates, having introduced the system of «kickbacks», misappropriated almost UAH 590,000 in cash paid to the institution's employees in the form of bonuses. In addition, the manager is suspected of extorting and receiving illegal benefits.  

The actions of the suspects are qualified under part 4, 5 of Art. 191, part 1, 2 Art. 364, part 3 of Art. 368, part 1 of Art. 366 of the Criminal Code of Ukraine.

Prosecutors are currently preparing motions to choose preventive measures and suspend suspects from their positions.

The total amount of established damages in these criminal proceedings is about UAH 50 million.

The pre-trial investigation is carried out under the procedural supervision of the prosecutors of the Volyn Regional Prosecutor's Office, Lutsk and Volodymyr District Prosecutor's Offices in interaction with the Main Department of the National Police,the Security Service of Ukraine Department, the State Bureau of Investigation and the Strategic Investigations Department in the Volyn region

Note: In accordance with art. Article 62 of the Constitution states that a person shall be presumed innocent of a crime and shall not be subjected to criminal punishment until his guilt has been proved legally and established by a court verdict.
