Офіс Генерального прокурора продовжує принципову роботу щодо очищення органів прокуратури від тих, хто дискредитує професію та намагається використати службове становище у власних інтересах.

За процесуального керівництва Офісу Генерального прокурора, завершено досудове розслідування та скеровано до суду обвинувальний акт стосовно колишнього керівника Хмельницької окружної прокуратури та члена Кам’янець-Подільської міжрайонної медико-соціальної експертної комісії.

Досудовим слідством установлено, що керівник прокуратури, не маючи на те жодних підстав, у змові з посадовими особами медико-соціальної експертної комісії протиправно домігся встановлення йому ІІ групи інвалідності. На підставі підроблених документів він безпідставно отримував пенсійні виплати упродовж кількох років. Загальна сума незаконно отриманих коштів — понад 1 млн грн.

До кримінальної відповідальності притягнуто і члена МСЕК, який сприяв у підробленні медичної документації та ухваленні незаконного рішення.

Водночас, за ініціативою Генеральної інспекції прокурора було притягнуто до дисциплінарної відповідальності. Рішенням КДКП його звільнено з посади прокурора.

Обвинувальний акт за обвинуваченням колишнього керівника прокуратури у шахрайстві в особливо великих розмірах (ч. 5 ст. 190 КК України) та члена МСЕК у службовому підробленні (ч. 1 ст. 28, ч. 1 ст. 366 КК України) скеровано для розгляду до Кам’янець-Подільського міськрайонного суду.

Примітка: відповідно до ст. 62 Конституції України особа вважається невинуватою у вчиненні злочину і не може бути піддана кримінальному покаранню, доки її вину не буде доведено в законному порядку та встановлено обвинувальним вироком суду.

Feigned disability and illegal payments. The case of the former head of the Khmelnytskyi Prosecutor's Office and a member of the Medical and Social Expert Commission was sent to trial for consideration on the merits

The Prosecutor General’s Office continues its principled activity to cleanse the Prosecutor's Office of those who discredit the profession and try to use their official position in their own interests.

Under the procedural supervision of the Prosecutor General’s Office, the pre-trial investigation was completed and the indictment against the former head of the Khmelnytskyi District Prosecutor's Office and a member of the Kamianets-Podilskyi Interdistrict Medical and Social Expert Commission (MSEC) was sent to trial.

The pre-trial investigation established that the head of the Prosecutor's Office, having no grounds for this, in collusion with the officials of the Medical and Social Expert Commission, illegally managed to establish the II group of disability for him. On the basis of forged documents, he unjustifiably received pension payments for several years. The total amount of illegally received funds — is more than UAH 1 million.

A member of the MSEC who assisted in the falsification of medical documentation and the making an illegal decision was also brought to criminal responsibility.

At the same time, on the initiative of the General Inspectorate, the prosecutor was brought to disciplinary responsibility. He was dismissed from the post of prosecutor by the decision of the Qualification and Disciplinary Commission of Public Prosecutors.

Indictment on the charge of the former head of the Prosecutor's Office for fraud in particularly large amounts (part 5 of Art. 190 of the Criminal Code of Ukraine) and a member of the MSEC in official forgery (part 1 of Art 28, part 1 of Art. 366 of the Criminal Code of Ukraine) was referred to the Kamianets-Podilskyi City District Court for consideration.

Note: In accordance with Article 62 of the Constitution a person is presumed innocent of a crime and may not be subjected to criminal punishment until proven guilty in a lawful manner and established by a court conviction.
