Registered the right of ownership of a private house, not put into operation - the suspicion was reported to a private notary

Under the procedural guidance of the Shevchenkivskyi District Prosecutor's Office of Kyiv, a private notary has been notified of suspicion for registering ownership of a private house that has not been put into operation.
It has been established that a man approached the notary with a request to legalize an illegally constructed house and fictitiously register ownership of it in the name of his wife. The suspect agreed to carry out the transaction despite a number of circumstances that made legal registration impossible, including:
- the house has not been put into operation;
- the object does not have a postal address;
- the future owner was not present during the signing.
As a result of the review of letters from the Shevchenkivskyi District Prosecutor's Office of Kyiv, the Ministry of Justice of Ukraine conducted a desk audit regarding the notary and temporarily blocked her access to the State Register of Property Rights to Real Estate.
The notary was notified of suspicion on October 18, 2025, under Part 3 of Article 362 of the Criminal Code of Ukraine, namely for unauthorized alteration of information, committed repeatedly, by prior conspiracy of a group of persons.
The sanction of the article provides for punishment in the form of imprisonment for a term of three to six years with deprivation of the right to hold certain positions or engage in certain activities for up to three years.
Other individuals involved in the commission of the specified crime are being identified.
Pre-trial investigation in the criminal proceedings is ongoing.
The criminal offense was uncovered by prosecutors in conjunction with investigators from the Shevchenkivskyi District Police Department of the Main Directorate of the National Police in Kyiv.
It should be noted that earlier, in August 2025, an indictment was sent to court against the notary for committing similar actions: at that time, the accused registered ownership of apartments in a multi-story building that had not been put into operation.
Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a guilty verdict of the court.
