Under the procedural supervision of the prosecutors of the Prosecutor General’s Office, the former acting director general and former deputy head of the department of design and preparation of the construction of the municipal enterprise «Pleso» were notified of suspicion under part 2 of Art. 28, part 2 of Art. 364 of the Criminal Code of Ukraine (abuse of official position, i.e. intentional, with the aim of obtaining an illegal benefit for another legal entity, use of official position by an official against the interests of the service, which caused serious consequences, committed by a group of persons based on a prior conspiracy).

According to the investigation, the private developer of one of the capital's residential complexes, in accordance with the terms of the investment agreement, had to finance and carry out works on the arrangement of the embankment and coastal fortification within the 50-meter coastal strip.

At the same time, the officials of «Pleso» ME unjustifiably included the specified object in the Program of Economic and Social Development of the capital and during 2018-2020 initiated the financing of these works at the expense of the budget of the city of Kyiv.

The works were completed, but not at the expense of the developer, but at the expense of the city. As a result of these actions, the territorial community of Kyiv suffered material losses of more than UAH 103 million.

The pre-trial investigation is ongoing. Documentation and exposure measures were carried out by prosecutors together with investigators of the National Police of Ukraine under the operational support of the State Security Service of Ukraine in Kyiv.

For the offence committed, the suspect is liable to a penalty of 3 to 6 years of imprisonment with deprivation of the right to hold certain positions or engage in certain activities for up to 3 years and a fine.

Note: according to Art. 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
