Ukrainian prosecutors will work at the International Criminal Court Prosecutor's Office in Ukraine

The Cabinet of Ministers of Ukraine has adopted a resolution on the signing of a draft Agreement between the Government of Ukraine and the Office of the Prosecutor of the International Criminal Court (ICC) regarding the deployment of personnel to the ICC Office in Ukraine.

The document provides for the deployment of Ukrainian prosecutors who will directly carry out the collection of evidence and procedural support for investigations of international crimes committed by the aggressor country during the armed aggression against Ukraine. They will work alongside ICC prosecutors, ensuring effective information exchange, coordination of actions, and the application of best practices in international criminal justice.

The Agreement defines the procedure for the secondment of prosecutors, guarantees their independence, and establishes their legal status. The implementation of the document will not require additional expenditures from the state budget.

The text has been developed based on the standard ICC agreement (Staff Secondment Agreement) and refined by the Ministry of Justice in collaboration with the Office of the Prosecutor General, in agreement with representatives of the ICC.

The conclusion of the Agreement, provided for by Article 44 of the Rome Statute of the ICC, will ensure the permanent presence of Ukrainian prosecutors in the office of international justice on the territory of our state. This will significantly strengthen the evidentiary base in cases of war crimes and crimes against humanity committed by the aggressor country, contribute to the protection of the rights of victims, and uphold the principle of the inevitability of punishment.

The Office of the Prosecutor General emphasizes: the participation of Ukrainian prosecutors in the work of the ICC Office in Ukraine is an effective tool in the fight for justice and holding accountable those responsible for crimes committed by the aggressor country.
