The prosecutor's office returned the right to a plot of land with an area of 7.5 hectares to the Kharkiv community

The Kharkiv Regional Prosecutor's Office ensured the return of a land plot to the territorial community of Kharkiv, located in the Shevchenkivskyi district of the city, with an area of over 7.5 hectares and a value of 107 million hryvnias. This land is situated next to the Oleksiivskyi meadow park, making it important for the preservation of green spaces in the city. When the plot is owned by the community, the city can develop it in the interests of residents rather than for private construction.
It was established that in 2021, the Kharkiv City Council illegally transferred a plot of communal property to a private joint-stock company for the construction of a residential complex with the demolition of non-residential buildings, bypassing mandatory land auctions.
Later, the right to use the plot and ownership of the buildings were resold to an individual, who subsequently transferred them to a limited liability company. As a result, the city community lost the opportunity to effectively use the land and maximize its income.
Prosecutors defended the interests of the community in courts of all instances. The Supreme Court ultimately confirmed the legality of the prosecutor's arguments and upheld the decision of the Eastern Appeal Economic Court, which obliged the private owner to return the land plot to the Kharkiv territorial community.
The court's decision has been fully executed, and the territorial community has once again gained the opportunity to manage its land legally and effectively.
“The land plot returned to the community from illegal rental constitutes over 6% of the area of the beloved meadow park, where tens of thousands of residents spend their summer leisure. No illegal schemes can deprive the community of its resources. The return of the plot is a victory for justice and a step towards the sustainable development of Kharkiv,” emphasized the head of the department representing the interests of the state in land relations of the Kharkiv Regional Prosecutor's Office, Dmytro Viter.
