By the lawsuit of the Volochysk District Prosecutor's Office, lands of the nature reserve fund within the territory of the hydrological reserve of national significance "Monachynskyi" have been returned to state ownership.
In order to protect the hydrological regime of the Hrabarka River, a tributary of the Zbruch River, the state hydrological reserve of national significance "Monachynskyi" was established in December 1980, with a total area of 220.64 hectares.
The Monachynskyi swamp massif plays a significant role in water regulation, accumulating surface runoff and contributing to the preservation of the water flow of the Zbruch River.
It has been established that in 2017, within the boundaries of the "Monachynskyi" hydrological reserve, a land plot was formed as agricultural land.
Subsequently, the Main Department of the State Geocadastre in the Khmelnytskyi region unlawfully disposed of them, transferring them to the communal property of the Volochysk City Council, which created risks for the further alienation of protected lands into private ownership.
Responding to the indicated violations of legislative requirements, prosecutors filed a lawsuit in the interests of the state, demanding the cancellation of state registration in the State Land Cadastre, the cancellation of the registration of property rights, and the return of the land plot.
The court found the prosecutors' arguments to be justified and ordered the return of the land plot to the state, represented by the Khmelnytskyi District State Administration.
