In the Kharkiv region, the prosecutor's office returned almost UAH 12 million to the budget through the court

The court granted the lawsuit of the head of the Chuhuiv District Prosecutor's Office of Kharkiv Oblast in the interests of the state against the limited liability company for the recovery of arrears in concession payments, including penalties, totaling approximately 12 million hryvnias.
It was established that in 2012, a private company, based on a concession agreement (the transfer of the right to use state property to a private entity with the obligation to pay fees), received management of the entire property complex of the state enterprise TPP-2 "Eskhar." The management term is 49 years.
According to the terms of the agreement, the concessionaire was to pay funds to the state budget quarterly; however, throughout 2024, it did not fulfill its financial obligations. As a result, a debt of approximately 12 million hryvnias was formed, which includes the principal debt, penalties, inflation losses, and 3% annual interest.
The failure to fulfill the terms of the agreement harmed the interests of the state in the budgetary sphere: the right of the state as the owner of the concession object to receive the due payments was violated, leading to a shortfall in state budget revenues.
These violations were the basis for the prosecutor's office to send the relevant lawsuit to the court.
By the decision of the Economic Court of Kharkiv Oblast, the prosecutor's lawsuit was granted: the private enterprise was obliged to pay the specified amount of debt to the state budget.
The period for appealing the decision is ongoing.
