The Kyiv City Prosecutor's Office in court prevented the illegal appropriation of residents of the LCD of the Dnieper Embankment

The Supreme Court agreed with the arguments of the Kyiv City Prosecutor's Office and terminated the ownership of the private company responsible for the riverbank reinforcement in the Berkovshchyna area. These are hydraulic structures within the protective coastal strip of the Dnipro River, covering a total area of over 2,300 square meters.

This concerns the embankment near the residential complex at 14 Dniprovska Embankment, located in the Darnytsia district of the capital.

The owners of the hydraulic structures installed barriers and gates, blocking access to the river for anyone who does not reside in the residential complex.

According to the technical documentation, the hydraulic structures are designed as an embankment nearly 500 square meters long. They serve the function of erosion protection. The private company registered its right of private ownership over them in 2020. However, the mentioned riverbank reinforcements are located on a communal land plot within the protective coastal strip of the Dnipro River.

In court, the prosecutor emphasized that the registration of private ownership rights over the hydraulic structures leads to the removal of the land plot from the ownership of the territorial community and restricts residents' unobstructed access to the Dnipro River.

The Supreme Court agreed with the prosecutor's arguments: ownership rights to the hydraulic structure cannot be registered by anyone.

Thus, the court put an end to this case – access to the Dnipro embankment should be available to all interested parties, not just the residents of one residential complex.
