$ 16,000 for "unfitness" in the army - prosecutors have directed the case of Ternopil to court

Prosecutors have sent an indictment to the court regarding a resident of Ternopil, who, through his connections among officials of the territorial center for recruitment and social support and members of the military medical commission, was supposed to assist in obtaining a "unfitness" for service.

The pre-trial investigation established that the accused offered a citizen to "resolve the issue" of being recognized as temporarily unfit for military service. He valued his "services" at 16 thousand US dollars.

Law enforcement officers detained the man under Article 208 of the Criminal Procedure Code of Ukraine while he was receiving part of the unlawful benefit – 15,200 US dollars.

The actions of the accused were qualified as receiving unlawful benefits for himself by influencing the decision-making of a person authorized to perform state functions (part 2 of Article 369-2 of the Criminal Code of Ukraine).

Under the procedural guidance of the Ternopil Specialized Prosecutor's Office in the defense sphere of the Western region, the pre-trial investigation was conducted by investigators of the Main Directorate of the National Police in Ternopil region with operational support from the Ternopil Department of the National Police's Internal Security Department and the military counterintelligence of the Security Service of Ukraine.

Note: According to Article 62 of the Constitution of Ukraine, a person is presumed innocent of committing a crime and cannot be subjected to criminal punishment until their guilt is proven in a lawful manner and established by a court verdict.
